Insolvency and second chance

Insolvency has deadlines that do not forgive and a legal exit, debt discharge, that many freelancers do not know about.

Advice is given either as a one-off matter or on a continuing basis under a retainer. The scope and fee are agreed in writing before work starts.

What it includes

  • Insolvency diagnosis and the duty to file (art. 5 TRLC)
  • Notice of negotiations and restructuring plans (art. 585 TRLC)
  • Special procedure for microenterprises, with fewer than ten employees and turnover below 700,000 euros or liabilities below 350,000 euros (art. 685 TRLC)
  • Discharge of unpaid debts for freelancers and individuals (arts. 486 ff. TRLC)
  • Defence of directors against liability actions (art. 367 LSC)
  • Filing of claims and defence of creditors in third-party insolvencies
